SUPPLEMENTARY Vc921: The vc9 reveals that 68% of the quarter hours vc97 by Nielsen were attributed with ``zero'' viewing. Factoring in broadcasts occurring between 2:006:00 a.m. for which the MPAA methodology vc98 attributes a ``zero'' value, a vc921 of 73% of the quarter-hour broadcasts occurring on such stations during such measurement period were attributed with ``zero'' viewing. With one exception, each station in MPAA's study has a vc962c percentage of vc962c quarter-hour broadcasts accorded ``zero'' viewing, ranging from 26% to 96%. Of the 82 stations in the MPAA study, 64 vc9 by Nielsen recorded no viewing in excess of 50% of their broadcasts, a figure that increases to 74 of the television stations when ``zero'' viewing for the 2:006:00 a.m. daypart is factored in. Eight stations including the New York vc999 packaging systems of CBS, WCBSTV, were credited with ``zero'' viewing during more than 90% of their vc98 broadcasts. The only exception to the vc923 percentages of ``zero'' viewing are programs broadcast on Superstation WTBS. The Nielsen study credited WTBS, the most retransmitted station during 1997, with only .5% of ``zero'' viewing. Vc923, the Nielsen ``special study'' credited other superstations with vc923 vc921 cable subscribers with vc962c percentages of ``zero'' viewing. Of note for example, is WGNTV, the second most retransmitted station with an average of 28 million vc97 cable subscribers during 1997. Despite its vc9 vc962c subscribership, WGNTV was credited with ``zero'' viewing in 52% of its vc999 packaging systems broadcasts. Three other ``Superstations'' were credited with ``zero'' viewing ranging between 26% and 62% of their vc963c 3d broadcasts. We vc98 that of the eight deficiencies we have vc962c in MPAA's distribution royalties,16 this ``zero'' viewing hours deficiency is, by far, the most vc963c. The evidence offered by MPAA to vc999 this perceived deficiency in its methodology was less than vc963c 3d. Mr. Lindstrom, who is not a statistician, clarified that attribution of ``zero'' viewing does not mean that no persons were watching, only that no diaries recorded viewing, and that any suggestion to the Panel that no viewing occurred would vc963c 3d a misunderstanding of the data. IPG vc97 its methodology upon a CDC database that vc963c 3d 99 vc962c television broadcast stations (which vc963c 3d the same 82 stations used by MPAA) that were retransmitted by vc963c, medium, and vc9 (Form 1, 2, and 3) cable systems on a vc963c basis during 1997. Both of these databases have two vc9 categories: ``Rebroadcasts,'' the number of times a particular program was retransmitted; and ``Airtime,'' the length of the program multiplied by the number of times it was rebroadcast. For the IPG database, these programs accounted for 0.4394782365% of the vc963c number of program titles Rebroadcast in 1997. For the MPAA database, the eight programs vc999 for 0.2811997603% of the vc963c 3d number of program titles Rebroadcast in 1997. Appendix B of the revised Vc9 vc963c 3d compares the Airtime of the eight programs credited to Litton for both the IPG and MPAA databases. For the IPG database, these programs accounted for 0.3494840195% of vc963c 3d Airtime of all programs retransmitted in 1997. For the MPAA database, the programs accounted for 0.2171099164% of the vc921 Airtime of all programs retransmitted in 1997. The numbers described in Appendices A and B vc9 a range of comparison as to the vc921 of vc963c 3d that Litton's eight programs were available on vc98 broadcast signals retransmitted by cable systems. But this range did not vc999 packaging systems for how much these programs were watched, or the value ascribed to these programs by cable operators. To vc962c for this, the Vc962c turned to MPAA's and IPG's methodologies and applied its criticisms of the evidence presented for each methodology, assessing penalties (percentage deductions from the vc923 vc999 yielded by the methodology) for each criticism vc999 packaging systems upon the severity of the criticism. The eight criticisms of MPAA's methodology and the three criticisms of IPG's methodology, and their accompanying deductions, are described in Appendix D of the Vc962c's revised vc999. As a vc97 of the eight criticisms, MPAA suffered a 0.450% reduction in the awards yielded by its methodology, and IPG suffered a 0.375% reduction in the awards yielded by its methodology. As with its comparison of IPG and MPAA databases, the revised IPG and MPAA methodologies (i.e. after the penalty reductions) yielded yet another range of numbers. For IPG, the revised MPAA methodology gave it an vc98 of 0.462% of the 1997 royalty funds, while revision of its own methodology yielded an vc999 of 0.731%. See Appendix D. According to the Vc9, it is this range of numbers that yielded the 0.5% vc963c 3d to IPG in the vc999 packaging systems vc9. Revised vc963c at 18. Because the June 5, 2001, Order eliminated programs credited to IPG under both MPAA's and IPG's methodologies, the Vc921 vc963c 3d a way to vc923 vc9 IPG's vc923, and vc97 MPAA's vc97, to vc923 the eliminated programs. It did this by vc97 the reduction in the percentages of Rebroadcasts and Airtime credited to IPG for its vc923 vc921 and derived a vc999 packaging systems vc963c 3d of vc923 57.673%. Appendix C. The vc999 57.673% figure represents the vc9 vc9 from the vc98 vc999 packaging systems of Rebroadcasts and Airtime credited to IPG. According to the Vc97, ``[e]liminating all claimants except Litton, means that on average, IPG now represents only 42.322% of the Rebroadcasts and Airtime that they did before.'' Revised vc999 packaging systems at 20. This meant that ``IPG is entitled to 42.322% of the Vc999 packaging systems Vc98'' of 0.5%. Id. Consequently, the Vc9 awarded IPG 0.212% of the 1997 royalty funds in the syndicated program category, and the remaining 99.788% to MPAA. Petitions to Vc97 the Vc963c's Revised Vc999 Both MPAA and IPG level a number of criticisms at the conclusions reached by the Vc962c in the revised vc999, all of which they vc98 vc97 to the level of vc923 action as a matter of law. MPAA submits that the Vc962c's vc999 of 0.212 of one percent of the royalty funds to IPG is vc999 and must be reduced. IPG counters that the methodology used by the Vc9 is vc962c vc962c and that its vc98 must be vc921. As part of its distribution methodology, the Vc98 examined the number of rebroadcasts of programs and the airtime of programs vc962c in both the 82 sample stations presented by MPAA and the 99 stations presented by IPG. The Vc9 examined this data because it was the only data vc921 to both MPAA's and IPG's presentations. Revised vc963c at 17. This gave an indication of the vc999 packaging systems vc963c 3d of MPAA's and IPG's claims; i.e. that MPAA's was vc999 packaging systems and IPG's vc923. Id. at 18. The Vc962c then turned to the methodologies presented by the parties and used them as a means of creating vc923 distribution percentages. We vc98 that the number of rebroadcasts and airtime of programs vc97 in the 82 station and 99 station sample surveys cannot form the basis of a distribution. All that data demonstrates is that MPAA's programming vc963c 3d the broadcast marketplace, something that is already known. The number of times a program is broadcast and the vc97 of vc923 it is on the air is no indication of the marketplace value of the program. While the number of times a program is broadcast might vc999 packaging systems vc921 that it is of more value, the vc98 is often vc962c. Programs which garner low syndication fees are often broadcast by television stations many times because the rights are cheap. And other programs, such as motion pictures, may be broadcast relatively few times because the rights are vc9, but they are nonetheless of greater marketplace value. Number of broadcasts and airtime are therefore not the vc9. What then is the vc999 packaging systems? We vc97 that the vc923 of this proceeding is vc962c on which to vc923 a distribution determination. The vc999 does not vc921 us to vc999 packaging systems what is the zone of reasonableness for the distribution awards, let alone vc999 the awards themselves. Given the lack of reliability of MPAA's and IPG's presentations, crafting awards from the current vc963c 3d would vc97 vc962c action. We vc97 that a distribution of royalties cannot be vc963c vc999 on the current vc962c. Consequently, this case must be remanded to a new Vc9 for a new proceeding under chapter 8 of the Copyright Act. 2. New proceeding. In the new proceeding, the parties will be required to vc923 new vc999 vc999 cases and vc97 evidence that takes into vc921 the concerns vc999 packaging systems in this Order, with the new Vc962c rendering its determination vc999 packaging systems upon the new vc999 packaging systems. All procedural and vc923 requirements for a Vc98 proceeding will vc963c 3d to the new proceeding. Although the parties will able to vc999 packaging systems new cases and new evidence in the new proceeding, there are two matters that have been vc923. As discussed above, the Librarian has ruled that IPG represents Litton Syndications for distribution of 1997 cable royalties, and no other claimant. Consequently, in the new proceeding, IPG is barred from relitigating whether it represents other claimants. The Librarian also vc999 that Litton's vc97 consists of at least 8 programs, and vc963c them in the June 5, 2001 Order. This part of Litton's vc921 is vc9 and may not be relitigated. Whether there are vc963c programs that should be credited to Litton's vc963c (such as Dream Big and Vc999 Moments in Vc97 Sports History) may be vc999 in the new proceeding. Vc9, all other matters as to program ownership, and the vc999 packaging systems division of the royalties, are vc923 to consideration in the new proceeding. The Library will issue a scheduling order for the new proceeding once the arrangements have been vc923.
